Acceptance of Terms
These Terms of Service ("Terms") form a binding legal agreement between you and Trackease Technologies ("Trackease", "we", "our", or "us") governing your access to and use of the Trackease platform, including all associated websites, APIs, and mobile applications (collectively, the "Service").
By registering an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Trackease on behalf of a business, you represent that you have the authority to bind that business to these Terms.
If you do not agree to these Terms, you must stop using the Service immediately.
Service Description
Trackease is a service management and item tracking platform designed for businesses that take custody of customer items — including but not limited to laundry shops, electronics repair shops, tailors, phone repair services, and appliance repair businesses.
The Service enables businesses to digitally record client item intake, capture photo and video evidence of items, track service status, generate digital receipts with QR codes, and give clients a way to check on their items in real time.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, though we will endeavor to provide advance notice of significant changes.
Accounts and Registration
Business Accounts
- Registration requires a valid email address and accurate business information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately at legal@trackease.com.ng if you suspect unauthorized access to your account.
- Each business account constitutes a separate workspace. Staff members added to a workspace act under the authority of the business owner.
- You may not share your account credentials with third parties or allow others to access your account on your behalf outside of the staff management features.
Account Eligibility
- You must be at least 18 years old to create a Trackease business account.
- Accounts may not be created by or for businesses engaged in illegal activities.
- We reserve the right to refuse registration or terminate accounts at our discretion.
Acceptable Use
You agree to use Trackease only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to engage in any unlawful activity or to facilitate illegal conduct
- Upload content that is defamatory, obscene, harmful, or violates any third party's rights
- Upload photos or videos of clients or their items without appropriate consent
- Attempt to gain unauthorized access to other business accounts or Trackease systems
- Reverse engineer, decompile, or attempt to extract the source code of the platform
- Use automated tools (bots, scrapers) to access the Service without our written permission
- Transmit malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access
- Misrepresent your identity or business when using the platform
- Use the Service to spam clients or send unsolicited commercial communications
Violation of this section may result in immediate account suspension or termination without refund.
Your Responsibility for Client Data
When you use Trackease to record information about your clients and their items, you act as the data controller for that information. This means:
- You are responsible for ensuring you have a lawful basis for collecting and processing your clients' personal data
- You must obtain any necessary consent from clients before capturing photos or videos of their items
- You must handle client data in compliance with applicable privacy and data protection laws
- You are responsible for the accuracy of data entered into the platform on behalf of your clients
- You must not enter false, misleading, or fabricated client information into the platform
Trackease processes client data on your behalf as a data processor. Our Privacy Policy describes how we handle this data technically and operationally.
Digital Receipts and Tracking Links
Trackease generates digital receipts and QR-code-based tracking links that allow your clients to check the status of their items. By using this feature:
- You acknowledge that anyone who possesses a valid tracking link can view the associated item status
- You are responsible for securely distributing receipts and QR codes to the correct clients
- You must not generate or share tracking links for items that do not belong to the associated client
- Trackease is not responsible for unauthorized access to tracking links that are shared insecurely
Payment and Billing
Certain features of Trackease may require a paid subscription. Where applicable:
- Subscription fees are billed in advance on a monthly or annual basis, as selected at signup
- All fees are non-refundable except where required by law or expressly stated in our refund policy
- Failure to pay may result in suspension of your account and loss of access to paid features
- We may change our pricing with at least 30 days' notice to active subscribers
- Applicable taxes may be added to the subscription price depending on your location
If you believe you have been incorrectly charged, contact us at billing@trackease.com.ng within 30 days of the charge.
Intellectual Property
Trackease's Property
- The Trackease platform, including its design, code, branding, and content created by us, is owned by Trackease Technologies and protected by copyright, trademark, and other intellectual property laws.
- These Terms do not grant you any ownership rights in the Service. Your right to use Trackease is a limited, non-exclusive, non-transferable licence that may be revoked at any time in accordance with these Terms.
Your Content
- You retain ownership of all content you upload to the platform, including photos, videos, and item records.
- By uploading content, you grant Trackease a limited licence to store, process, and display that content solely for the purpose of providing the Service to you.
- We do not claim ownership of your business data or your clients' data.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Trackease disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that the results obtained from using the Service will be accurate or reliable.
Trackease is a record-keeping and tracking tool. It does not guarantee the physical safety of items in the custody of businesses using the platform, nor does it guarantee dispute outcomes between businesses and their clients.
Limitation of Liability
To the maximum extent permitted by applicable law, Trackease Technologies, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of goodwill — arising from your use of or inability to use the Service.
Our total aggregate liability to you for any claims arising out of or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or USD $100, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
Termination
You may close your account at any time by contacting us at support@trackease.com.ng. Upon closure, your access to the Service will end and your data will be handled in accordance with our Privacy Policy.
We may suspend or terminate your account immediately, without prior notice or liability, if:
- You breach any provision of these Terms
- You engage in fraudulent, abusive, or illegal activity
- We are required to do so by law
- Continued provision of the Service to you is no longer commercially viable
Upon termination, provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and governing law — will remain in effect.
Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service will first be addressed through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or the appropriate courts of competent jurisdiction.
You agree not to bring any class action or representative proceedings against Trackease.
Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will notify registered business account owners via email and update the "Last Updated" date on this page.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
